During the second reading of the project of the Specker on defense investments, further amendments were made. KO proposed deletion from the project of allotment gardens, and Deputy Minister of Defense Cezary Tomczyk assured that the special law would not interfere in the ROD.

The proposed special law is to simplify the procedures for the preparation and implementation of key investments in defense. The regulations are to improve, among others Construction along the eastern border of the installation as part of the “Targe of the East”, construction of new military units, warehouses or training grounds, as well as investments in the expansion of the arms industry.

During the second reading of the project in the Sejm, the commission rapporteur Andrzej Szewiński (KO) emphasized that the Act regulates the procedure for purchasing real estate necessary to implement strategic investments in terms of state defense. He pointed out that the regulations are of a specialist, and their intention is to shorten the time of implementation of defense investments. He added that the body qualifying the tasks in the Specter mode will be the Minister of National Defense. Other investments will be implemented on general principles.

Szewiński made further amendments to the project on behalf of KO. When asked by PAP about the content of the amendments, he announced that they were deleting entries regarding the possibility of investing investments in allotment gardens.

Artur Chojecki from PiS made a minority amendment. As Chojecki explained, the decision to transfer equipment to third countries should be taken by the Council of Ministers, not the organizational units of the Ministry of National Defense. Hence – as he said – his club – wants to delete the provision, according to which “, with the consent of the Minister of National Defense, organizational units may, together with the armed forces of foreign countries, countries or international organizations, acquire military equipment for the armed forces and the armed forces of foreign countries, countries or international organizations.”

Andrzej Tomasz Zapałowski (Confederation) also raised doubts. Anna Wojciechowska (KO), Wioleta Tomczak (Poland 2050-TD) and Radosław Lubczyk (PSL-TD) spoke positively about the project. Joanna Wicha (left) announced that her club will support the project, but she will watch the implementation of regulations, among others in environmental issues.

Ewa Leniart (PiS) alarmed that defensive investments could deprive some of the inhabitants of the property, which will become the property of the state on the day of expropriation.

Deputy Minister of Defense Cezary Tomczyk (KO) emphasized that the special law shortens the investment process in key investments for state security in some cases by 50 %, and in some by 70 percent. He gave an example from the Air Cavalry Brigade from Tomaszów Mazowiecki, where the investment in the form of a door to a law firm lasted 5 years, which – as he noted – is absurd.

Tomczyk pointed out that the special law was written with the army and for the army so that infrastructure investments could be implemented without bureaucracy.

He noted that the opposition's comments were taken into account during the work on the project. “We took the comments of PiS deputies that referred to the issue of joint purchases. This recipe I know that it will be clarified by amendment,” he said.

He assured that the issue of donation for the benefit of third countries, which MP Chojecki talked about. “It must be as an individual prerogative of the Council of Ministers. After clarification, the Act will in no way refer to the issue of donation for the benefit of third countries,” he announced.

He also stated that after the consultation and meeting of the Commission, it was decided to exclude the issue of allotment gardens from the special law. “We do not anticipate any interference in allotment gardens. The whole element is excluded from this act and thank you very much for this amendment,” he said.

In connection with the submission of subsequent amendments, the project of the Specker was re -directed for consideration by the Administration and Internal Affairs Committees and National Defense, which will deal with it on Wednesday morning.

The project involves the division of investments into key investments, such as the East shield and ammunition production and strategic investments. The changes concern, among others issuing environmental consent, investment implementation on state lands and based on local enterprises. The regulation also provides for the possibility of expropriation of real estate for compensation and creating protective zones of closed areas. In addition, it releases purchases of unmanned aerial vehicles and the means of combating them from the obligation to apply the public procurement law. The condition is the consent of the head of the Ministry of National Defense and the army testing drones.

The proposed special law assumes the issue of one complex administrative decision to permission to implement a strategic investment. The decision to carry out a strategic investment regarding the needs of state defense (DRSI) will be issued by the voivode within 90 days from the date of submission of the application by the investor.

The list of key investments regarding the needs of state defense, including investments implemented as part of the Targe East program and key investments in the field of public security needs, will be determined by the Minister of National Defense.

The investor will submit a notification about the implementation of a key investment to the voivode and the Provincial Inspector of Building Supervision, and in the case of investments in forest areas to the Director of the Regional Directorate of State Forests.

If the Regional Environmental Protection Director finds that the implementation of a key investment may have a negative impact, among others In the Natura 2000 area, then he is to specify in the decision, in cooperation with the investor, minimizing or alternative solutions. If this is not possible, it is to determine the scope, place, date and manner in which nature compensation.

The project also sets out the rules for purchasing real estate for the needs of investment and determining compensation for real estate. The current shape of the project assumes, among others, that if the decision to permission to implement a strategic investment applies to family allotment gardens, the investor is required to pay allotment to the allotment, including for planting and construction facilities on plots. Fears of these provisions were raised by the Polish Association of Allotment Workers. (PAP)
