Andrzej Duda decided on the Act on the Military Property Agency


On Wednesday, late in the evening, the President's Chancellery announced that on April 29, 2025, Andrzej Duda signed the Act of 4 April 2025 amending the Act on the Military Property Agency.
“The aim of the Act is to enable the Military Property Agency more effective implementation of tasks for defense and state security” – we read in a short announcement.
“The Act introduces two categories of changes in the amended Act on the Military Property Agency. The first is aimed at extending the entitlement of AMW in the scope of managing the property of the Treasury and to expand the catalog of types of property transferred to it. The second goal is to eliminate competence discrepancies that appear between AMW and institutions, commands or military units involved in the organization of events promoting the Polish Armed Forces, in particular International Air Show Air Show ” – we read.
The amendment to the Act on the Military Property Agency (AMW) provides that the Agency will be able to transfer or dispose of the armed forces of other countries for the State Treasury or double application products (i.e. both military and civil) and armament.
The value of the transferred property, also free of charge, will be determined according to market value, taking into account physical or economic consumption resulting from technical and economic progress. In the event of the sale of property, in addition to its value, the price may also include the amount of costs incurred by the AMW, the amount of taxes and the amount of expenditure incurred for examinations and development of the sold property.
The agency will determine the value of the transferred property and the price of sale in consultation with relevant organizational units subordinate to the Minister of National Defense or the minister competent for internal affairs or supervised by them.
The amendment also clarifies the provisions on the tasks of the AMW. It is about indicating that these tasks include organizing together with units subordinate to the Minister of National Defense or by him supervised as cooperating entities, projects related to the promotion of the Polish Armed Forces, including air shows. In order to carry out these tasks, the Military Property Agency will be able to conclude agreements, in particular with local government units, government administration, non -governmental organizations, universities and research institutes and entrepreneurs.
The amendment was voted in the Sejm on April 4. The novella was then unanimously adopted in the Senate on April 23. The president signed it on April 29. The Act will enter into force after 14 days from the date of publication in the Journal of Laws.
