The Parliament extends the ban on the sale of state agricultural land


427 MPs voted in favor of adopting the new regulations, two were against and five abstained.

The current regulations provide for: the sale of state agricultural land remains suspended until April 30, 2026. The preferred form of land use is leasing.
The amendment passed by the Sejm extends this deadline by another 10 years, which means maintaining the current policy regarding the management of land belonging to the State Treasury.

Sale of land without the consent of the Minister of Agriculture. The Sejm increased the limit
The new regulations also introduce changes regarding exceptions to the ban. The maximum area of land that can be sold to a farmer without the need to obtain the consent of the Minister of Agriculture will be increased – from the current 2 to 5 hectares.
Deputy Minister of Agriculture Jacek Czerniak, answering MPs' questions, said that resignation from the consent of the Minister of Agriculture, in accordance with the PSL amendment, will shorten the decision-making time by 6 months. He emphasized that these lands are sold to individual farmers.
“In the years 2016 – 2025, applications for consent to the sale of agricultural real estate between 2 ha and 5 ha accounted for 35 percent of all applications, but concerned only about 5 percent of the total area of the property. In total, there were 408 such applications out of a total of 1,185,” said Deputy Minister of Agriculture Jacek Czerniak during the parliamentary debate.
This regulation has facilitate access to small plots of land for small farmerswhile maintaining the general principle of protecting state lands against widespread privatization.
