The Ministry of Digitization is working on introducing a tax on digital activities, which aims to equalize opportunities between global players and Polish and European entrepreneurs. In addition, in July this year. There was a trade agreement between the European Union and the United States, but the findings lacked tribute from digital platforms. According to Polish MEPs, decisions related to its introduction should be made in coordination between Member States, and also taking into account the relations with the US, especially in the context of cooperation for Poland's defense.

– If decisions regarding the taxation of large digital platforms were to be collapsed, then in coordination between EU countries, but at the same time also taking into account our transatlantic interests. This type of movement could be found, for example, with a symmetrical response in another commercial area related to our relations between the European Union and the United States – says in an interview with Newseria's agency Piotr Müller, a Member of the European Parliament from Law and Justice.

According to the report of the Instrat Foundation “Taxation of digital activities” prepared at the request of the Ministry of Digitization, which is the basis for the proposal to introduce digital tax in Poland, one of the greatest threats related to it is to expose relationships with the United States, our key ally.

– There is a security thread, i.e. America's involvement in the protection of NATO's eastern flank and even the presence of American troops in Poland. Therefore, we should discuss this topic comprehensively. Think about how to honestly create taxes for companies that operate in Europe, but on the other hand, however, take into account all security interests, in particular Poland – believes Piotr Müller.

In the light of the official data of the US Department of State, about 10,000 are currently stationed in Poland. American soldiers. In addition, the US armed forces prove the combat group of a reinforced extended presence (EFP) in Poland and distribute a rotary armored combat team as part of the Atlantic Resolve operation, financed by the European deterrent initiative.

– I would like this policy to be coordinated, because then it would bring results. Finally, I would also like taxes from taxes to domestic budgets and not to the EU budget. There is a tendency in Brussels, in Strasbourg, that all new types of public tribute should be directed to the EU budget. I am in favor of looking after the tax autonomy of countries – explains Piotr Müller. – Membership contributions may go to the budget, but the increase in independent sources of financing the EU budget in the future will simply lead to trouble, because it will cause further tensions about how to later divide these funds between countries – he adds.

On August 13, 2025, at the Ministry of Digitization, there was a meeting with a wide representation of industry and non -governmental organizations, which aimed to discuss the digital tax model for Poland, on which the work lasted several months. The proposed solutions assume taxation of digital interface services, services of digital targeted advertising (profiling) as well as data transfer services. On the basis of the model, a bill is to be prepared, which will then be widely consulted.

– The introduction of digital tax in Poland is a very complicated process also because we have strategic defense interests and we should discuss what is more important to us at the moment – says PiS MEP.

– Is a bright signal from the United States about the presence of American troops in Poland, or maybe taxation of American concerns, or maybe getting along, where here we have a common consensus to achieve. For example, by increasing American troops in Poland and then deciding that we do not introduce some kind of tribute. It is worth talking about it honestly and showing our expectations in this area – he adds.

On July 27, 2025, the European Union and the United States concluded an agreement on the framework of a mutual, honest and sustainable trade agreement. One of its most important resolutions is to cover most of the EU goods to USA 15 %. duty.

– The trade agreement, which is currently being processed and has been established between the European Commission and the United States, does not assume this type of tax, so we are currently after arrangements when it comes to two sides, so opening this dispute again may cause further perturbations on the international arena – believes Piotr Müller.

– However, this does not change the fact that we must look for a way to make international corporations pay fair taxes in Europe and in individual EU countries. This does not necessarily have to be done by digital tax, but also, for example, by better guarding the tax residence of the company that provides services – he adds.

According to the institt report, global digital companies mostly do not have daughter companies registered in Poland. Services are most often provided by companies registered in other European countries, such as Ireland or the Netherlands, or directly in the USA. In addition, the margin reached in registered entities in registered in Poland is significantly smaller than it results from the financial statements of companies operating at the global level. This testifies to the problem, among others use of transfer prices to overstatement and thus paying lower CIT tax.

– I don't mind good competition in the European Union. When it comes to tax policy issues, countries must also compete with each other, there are good market mechanisms. But if the product or service is implemented in a given country, it is honest that the financial resources will receive them, and not virtually to another place, which is so -called tax paradise and which has nothing to do with the performance of this service or product – believes the MEP Law and Justice.
