Tudorel Toader said that budget balancing cannot be done by reducing pensions in the justice system and that the principle of equality before the law cannot be applied evenly in this case.
“I can say with all the conviction that the politicians have made an election campaign subject regarding the pensions, salaries and retirement age of the magistrates. The state budget is not balanced by reducing the pensions of the magistrates. The budget should be balanced by stopping the generalized robbery from the top. By adopting laws with dedication, laws who followed and solved many interests ”, said the former minister, in an intervention at Digi24.
Tudorel Toader also commented on the interview of the president of the SCM, Elena Costache, who had stated that a pension of 11,000 lei for a magistrate is small. He said that his statements “They put gas on fire,” But that the message about professional inequality is correct:
“The lady president said very correctly not to compare apples with pears. He said that the principle of equality before the law does not mean uniformity. Equality is for those who are part of the same socio-professional category.”
Referring to the PNRR obligations regarding the reform of the special pensions, Toader warned that “Objectives that violate the Constitution cannot be foreseen.”
He explained that although the retirement age is not a constitutional standard and could be modified, the amount of the pension must remain as close to the payment salary, according to the CCR jurisprudence.
Tudorel Toader also drew attention to some abuses in the system, which he stated to be “Absolutely unnatural” For some former magistrates to have higher pensions than wages, and that the cases in which, in the last month of activity, increases have been added to artificially increase the pension calculation.
