The court established that the woman from the town of Iasi Cucuteni acted in legitimate defense, after enduring more than three decades of physical and mental abuse.
According to witnesses and statements of the son of the two, the woman lived for 32 years under the terror of a recognized husband for her violence and excessive alcohol consumption. Neighbors reported that the woman was almost daily assaulted, being beaten with hair or other objects.
The tragedy spent on the night of August 15, 2022, when the man woke up angrily and began to hit her with his fists, reproaching him that he did not do his job in the household. At one point, he took a metal and hit her in the face area. Fearing for his life, the woman put her hand on a knife and stabbed her husband. The blow was fatal.
Initially, the Iași Court rejected the defense invoked by the woman's lawyer, accusing her of killing a family member, a fact that could have brought up to 25 years in prison, but the Court of Appeal re-analyzed the case and reached a different conclusion.
The judges concluded that Maria Andrieș acted justified, in an attempt to save her life, in a context of systematic domestic violence. “The man had just taken a break,” the court is shown, quoted by Ziarul de Iași, emphasizing that the attack was not a singular episode, but part of a long series of abuses that have spread over 30 years. The decision of the Court of Appeal is final.
