The Superior Council of Magistracy (CSM) has decided to convene the general meetings of judges and prosecutors for Monday, June 30, against the background of dissatisfaction with the measures proposed in the Governance Program regarding the justice reform. Magistrates will discuss a request to politicians not to change the status of judges and prosecutors.

In a press release issued on Thursday, the SCM argues that the return to the public discussion of some essential aspects of the status of judges and prosecutors is done with “ignoring the real problems of the judicial system”. At the same time, the institution points out that the measures proposed in the governance program assumed by the Executive will have as “unique impact the destabilization of the Public Justice Service”.

The SCM reaffirms that the judicial authority has a constitutional status of power in the state and warns of the risks generated by the “constant stigmatization” of the magistrates in the public space.

Moreover, the Council emphasizes that the level of pay and the pension conditions of the magistrates must comply with the European documents, the jurisprudence of the Constitutional Court, the incompatibilities and prohibitions of the function, the volume of work and its complexity.

The SCM recalls that it has proposed solutions to reduce the budgetary expenses, including the abolition of courts and prosecutor's offices or the accelerated digitalization of the files.

“To the extent that it is desired to make real economies to the state budget, and not only to adopt some measures with media impact, but without substance, the Superior Council of Magistracy considers that there are real and efficient solutions to achieve this goal, proposed by the Council, such as:

– reorganization of the judicial activity by terminating some courts and prosecutor's offices (at least one court/prosecutor's office in the constituency of each court/prosecutor's office next to the court);

– generalization of exclusively electronic communication, at least in relations with public institutions;

– accelerating the digitalization process to tend to an exclusively electronic file, at least in the cases concerning public institutions and/or professionals, with the consequence of substantial reduction of consumables (paper without paper);

-increasing stamp duties in accordance with the socio-economic reality, so that they reflect the expenses involved in resolving disputes, correlated with appropriate measures to make the judicial public aid;

– The adoption of efficient measures to recover the damages resulting from the commission of crimes ”, it is stated in the press release.

Establishing the retirement age at 65 years, eliminating the cumulation of the pension with the salary, eliminating the unjustified daytime, re-enlargement of the pensioner magistrates, by increasing the return period from 3 years to 7 years are part of the measures in the field of justice that are found in the draft of the governing program 2025-2028, consulted by Hotnews.

In total, 39 measures are proposed in the document consulted by HotNews.ro, many of them are proposed, many of them specifying that they will be applied “in compliance with the CCR decisions”. These include limitation to a single 5 -year term for high -ranking prosecutors, reassessment of the law of pay, reorganization of courts and prosecutor's offices, setting up specialized sections for the business environment and introducing mechanisms that reduce the volume of cases in courts.
