Woman dead for three years, fined by the Local Police for illegal parking. The court rejected the appeal filed by the family

The Local Police of Cluj-Napoca issued a fine for illegal parking in the name of a woman who had died three years before. The court rejected the complaint filed by her brother.

The fine was applied in the spring of 2023, when the local police found a car parked illegally on a sidewalk in the city, Clujenii.ro reports.

The misdemeanor report, worth 200 lei, was drawn up in the name of the owner of the car, without the agents checking if the woman is still alive. The owner of the car had been deceased since July 2020.

The woman's brother challenged the sentence in court, arguing that his sister could not possibly be responsible for the 2023 act.

Although the situation seemed obviously absurd, the Cluj-Napoca Court did not get to analyze the merits of the case. The magistrates rejected the complaint on the grounds that the man does not have active procedural status, since the fine was not issued in his name.

The court specified that only the violator or persons expressly provided for by law can file such an appeal, even in unusual situations like this one.

Therefore, the sanction remained valid, at least temporarily. The decision can be appealed within 30 days.

We remind you that, five years ago, a woman from the commune of Vinţu de Jos, Alba county, contested in court a record of sanctions concluded by representatives of the City Hall, who also fined her husband, who had been deceased for 13 years.
