Krasnoyarsk sued a Moscow company for a burst breast implant

A Moscow company selling medical products must pay a resident of Krasnoyarsk 837,750 rubles for breast reconstruction surgery. The silicone implant turned out to be defective, the joint press service of the regional courts reported.

IN The woman’s claim stated that in 2017, for 280,000 rubles, she underwent augmentation mammoplasty with anatomical endoprostheses in a capital clinic. The installed French breast implants were givenlifetime warranty. But in March 2024, an MRI revealed signs of an intracapsular rupture of the right breast implant. The case was recognized as under warranty, the supplier offered to replace the low-quality product. Despite the fact that breast implants are a paired product, only one was replaced free of charge – the right one, and I had to pay for the second one.

The woman in court demanded compensation for expenses incurred in connection with the need to replace implants: 360,080 rubles – repeated surgery and treatment; 7,090 rubles – payment for MRI; 5,855 rubles – appointment with a surgeon; 9,100 rubles – medical examinations; 4,110 rubles – purchase of special underwear; 47,500 rubles for replacing a low-quality implant; damages in the amount of 431,000 rubles and compensation for moral damage in the amount of 100,000 rubles.

Having considered the case, the Kirovsky District Court of Krasnoyarsk recovered from the NGOAbout Nika-Med (importer of implants from France to Russia) in favor of the woman, damages in the amount of 478,500 rubles, compensation for moral damage – 80,000 rubles and a fine for non-compliance with consumer requirements – 279,250 rubles.
