The court overturned the decision to discontinue the proceedings against Bąkiewicz

The District Court in Gorzów Wlkp. overturned the decision of the Słubice court to discontinue the proceedings against Robert Bąkiewicz. The prosecutor's office accused him, among others, of: for insulting Border Guard and Military Police officers at the border crossing in Słubice – said Roman Makowski, spokesman for the district court.

Judge Makowski told PAP that on Monday, at a closed session, the judge examining the complaint overturned the decision of the Słubice court, considering it unfounded, and obliged the first-instance court to continue the proceedings.

– The judge overturned the decision to discontinue the proceedings, considering it premature and not based on a thorough analysis of the evidence and the facts. This means that the case returns to the District Court in Słubice, and its consideration under general principles will be handled by a judge other than the one who discontinued the proceedings, Makowski told PAP.

Bąkiewicz, who arrived in Gorzów on Monday and was supported by a group of members of the Border Defense Movement in front of the district court building, referred to this decision in an entry on the X portal.

“What the court in Słubice previously crushed and left no stone unturned is now suddenly back on the docket. Absurd. It is clear that the old Stalinist principle is coming back – give me a man, I will find a paragraph against him,” Bąkiewicz wrote on X.

On December 31, 2025, the District Prosecutor's Office in Gorzów Wlkp. submitted an indictment in this case to the Słubice court. She accused Bąkiewicz of insulting four officers of the Border Guard and Military Police on June 29, 2025 at the border, slandering a female Border Guard officer on the X portal and slandering various groups of people on the same portal.

Bąkiewicz was also accused of inciting hatred on the basis of national, ethnic and racial differences by posting in his posts on the X website and in interviews on YouTube, statements that arouse and intensify in their recipients feelings of strong reluctance and hostility towards people of German nationality and immigrants.

Bąkiewicz did not admit to the charges against him from the beginning. For the acts charged by the prosecutor, he is liable to a fine, restriction of liberty or imprisonment from one to three years.

Robert Bąkiewicz is an activist of national circles. It appeared on the Polish-German border as part of the so-called citizen patrols. He also established the Border Defense Movement – a nationwide social initiative whose aim is to “defend Poland against mass migration and the threats related to it.” (PAP)
