The prosecutor in the Recorder documentary, “shocked” after the president's announcement: “For those who still believed that Romania was a state of law, today you have proof to the contrary”

Prosecutor Claudiu Sandu, former vice-president of the Superior Council of the Magistracy, declared himself “shocked” on Wednesday evening, after the announcement by President Nicușor Dan regarding the signing of decrees appointing seven of the eight prosecutors proposed by the PSD Minister of Justice, Radu Marinescu, to head the General Prosecutor's Office, DNA and DIICOT.

Considered one of the reformist prosecutors in the CSM, Claudiu Sandu states, in a reaction on Facebook, that the decision to appoint the heads of the major prosecutor's offices is “exclusively political”.

“I watched the conference of the president of Romania. Far be it from me to criticize the manifestation of the will of the elected people. Something else shocked me”, prosecutor Claudiu Sandu begins his message, entitled “Disappointment”.

Known for his criticism against abuses in the justice system, the former CSM vice president claims he was shocked by the president's claim that the selection procedure was free but prosecutors refused to sign up.

“I told him, when I was invited to Cotroceni for consultations, that the prosecutors know that the decision is political and, if he wants a real competition, he should send a message that gives confidence to the participants that they have a chance. No such message came. Now he says that the prosecutors refused to sign up for a free competition. Is there any normal person in his head who would think that it was a competition?”, asks Claudiu Sandu rhetorically.

The prosecutor also referred to the president's statement that there was a lot of information in
the public space but there is no evidence “What do you mean by evidence? Isn't the fact that some magistrates risked their careers and even their lives to reveal how to change the completeness in cases with stakes be evidence? Or is it necessary for the defendant to admit the crime committed; otherwise it is not evidence. The fact that the careers and lives of honest and brave people such as Camelia Bogdan, Cristi Danilet and many others were destroyed, some winning his justice only in front of the European courts, isn't that enough evidence?”, the prosecutor asked.

Claudiu Sandu says that in his capacity as a CSM member he tried to do his job “with all his might
the responsibility and with all the skill that almost 25 years of career give me”. In his opinion, all five prosecutors of the Section within the CSM did their “maximum” to evaluate the candidates proposed by the Minister of Justice for the head of the prosecutor's offices.

“It seems that it is in vain. The decision is exclusively political. For those who believed that Romania is a state of law, today you have proof to the contrary. In reality there is only one power. The political power. Which does not work for the honest citizen in any case. The political power is immune. It ensures immunity and claims that it assumes its decisions. In reality, how many politicians have you seen pay in recent years for the decisions made? But how many magistrates have you seen paying for the courage to investigate politically protected persons? Politicians have made scapegoats for the misfortunes of the country. We must accept the reality,” concluded Prosecutor Sandu.
