The court returned to the state 10.5 hectares of the Yenisei bank, which through a series of transactions went into private hands

The prosecutor's office of the Krasnoyarsk Territory has achieved the return to federal ownership of a large plot on the right bank of the Yenisei in the Sosnovoborsky district. We are talking about an area of ​​10.5 hectares, which was originally allocated for a boat station back in 1980.

As the audit established, in 2015 the administration of the Esaul village council transferred this site to the Chaika boat cooperative free of charge. A few months later, the chairman of the cooperative sold the land to a private individual for only 10 thousand rubles, and he soon resold it back to the chairman at the same price. Then the plot was split into 168 parts – part went to the members of the cooperative, and 78 plots remained in the personal property of the manager.

The prosecutor's office went to court and proved that the transferred territory included the Yenisei water area and the coastal strip, which by law are federal property and could not be alienated by a decision of the village council. The court decided to withdraw all formed plots from private ownership.

Nowadays, garages are densely located on this bank. The buildings will remain in place, but all plots will be removed from the cadastral register, the land will again become a single massif in the ownership of the Russian Federation, and the cooperative will be able to use it under the previous right of permanent use, as in the 80s.

If one of the owners wants to register the land under the garage as personal property, he will have to carry out cadastral work at his own expense, coordinate the boundaries with the state and pay a fee. In this case, the site should not extend into the 20-meter coastal strip – the public access zone.

The defendants tried to appeal the decision, but a higher authority upheld it.
