The court decided: Ziobro's real estate encumbered with a compulsory mortgage

The District Court in Rawa Mazowiecka decided to charge the so-called compulsory mortgage of the real estate of former Minister of Justice, PiS MP Zbigniew Ziobro. The decision was made on Wednesday and is not subject to appeal, PAP learned from the Łódź district court.


Property security is intended to ensure the enforceability of any future property court judgments. The National Prosecutor's Office accuses Ziobro of leading an organized criminal group and using his position for criminal activities.
As the spokesman for the District Court in Łódź, Judge Grzegorz Gała, told PAP, as a result of the request of the National Prosecutor's Office to enter a compulsory mortgage on Zbigniew Ziobro's real estate, on Wednesday the District Court in Rawa Mazowiecka decided to make such an entry in the land and mortgage register.
– At the request of the National Prosecutor's Office, there were a total of four separate applications, all of them were accepted and an entry about such security was placed in the land and mortgage registers of the properties that were to be the subject of property security – he said. He added that the court's decision is not subject to appeal.
The spokesman explained that the further procedure in this case would consist in notifying both the applicant, i.e. the National Prosecutor's Office, and the debtor, i.e. the PiS MP and the former head of the Ministry of Justice, about the fact that the security was secured and the entry in the land and mortgage register.

Court regarding the imposition of property security, among others He sued for the third time against the house belonging to Ziobro in Jeruzal near Skierniewice. The previous two applications submitted by the National Prosecutor's Office were rejected due to deficiencies.
In January, a modified application was sent to the land and mortgage register department of the District Court in Rawa Mazowiecka. – The change consisted in clarifying and specifying the method of property security by clearly distinguishing mortgages corresponding to particular types of secured receivables. The decision clearly indicates the scope, amounts and creditors assigned to specific mortgages, explained Przemysław Nowak, spokesman for the National Prosecutor's Office.
As he recalled, for the first time in November last year, the prosecutor issued a decision on property security for Ziobro's property by encumbering his real estate with a compulsory mortgage and seizing the funds accumulated in his bank account. – Property security is intended to ensure the enforceability of future court decisions of a property nature (fine, obligation to compensate for damage, forfeiture, return of benefits) by preventing the suspect from disposing of, encumbering or hiding the property – he explained.
According to the Code of Criminal Procedure, if a suspect is accused of committing a crime for which a fine or, for example, an obligation to compensate for damage may be imposed, the prosecutor may ex officio secure the execution of this judgment on the suspect's property if there is a justified fear that without such security, execution of the judgment will be impossible or significantly difficult.
– In this case, both conditions for applying property security were met – said the PK spokesman.
The National Prosecutor's Office accuses Ziobro of leading an organized criminal group and using his position for criminal activities. According to the prosecutor's office, Ziobro committed 26 crimes, including: give orders to his subordinates to break the law in order to provide selected entities with subsidies from the Justice Fund, interfere in the preparation of competition offers and allow funds to be awarded to unauthorized entities.
In mid-January, the District Court for Warsaw-Mokotów adjourned the hearing on the prosecutor's office's application for pre-trial detention against the former head of the Ministry of Justice until February 5. If the court accepts the request for arrest, the prosecutor's office – according to its announcement – will issue an arrest warrant for the former minister and, on its basis, further searches for the PiS MP throughout the country will be launched. If, in the course of these activities, the services determine that Ziobro is not on Polish territory, the next stage of the prosecutor's office is to launch a search on the basis of a European arrest warrant.
Currently, Ziobro is granted political asylum and international protection by the Hungarian authorities, who have concluded that he is at risk of political persecution. This decision was made in December last year. Ziobro himself stated, among other things, that he would remain abroad until “real guarantees of the rule of law are restored in Poland” and that he chose “to fight political banditry and lawlessness.” (PAP)
