The Ministry of Sport and Tourism is preparing a blow to investments in apartments for rent. And this is regardless of whether the owners will also use the premises occasionally. “Rzeczpospolita” obtained a draft bill that imposes the obligation to meet strict fire protection regulations, as for ordinary real estate.

The Ministry proposes amendments, among others: Act on hotel services and the services of tour guides and tourist guides. In the new version you can read that

simplified fire safety requirements will apply to buildings in which no more than 6 premises are rented for short-term purposes and the number of beds does not exceed 30. Apartments for rent cannot be located higher than 25 meters above ground level.

Otherwise, apartment buildings will have to meet the requirements regarding fire protection that apply to hotels. According to experts, in practice this is impossible.

In addition, there is the need to register and properly mark short-term rentals. In practice, communities will know whether the conditions in their building are met. Same with the services.

Vacatio legis is to be established for 5 years.

This is part of a broader strategy aimed at tightening the occasional rental market. The project also assumes that municipal councils will be able to designate zones in which hotel services cannot be provided in facilities other than hotel facilities.
