The introduction of the possibility of independently downloading electronic documents from the Central Information of Land and Mortgage Registers via the mObywatel application – is envisaged in the published draft amendment to the Act on Land and Mortgage Registers and Mortgage and the Act on the National Court Register.


The draft amendment to the Act on land and mortgage registers and mortgages and the Act on the National Court Register is part of the government's deregulation package. It provides for the possibility for interested parties to independently download electronic documents from the Central Information of Land and Mortgage Registers via the mObywatel application.
The proposed regulations also provide for the modification of the mObywatel application in such a way that it will be possible to obtain through it data from the National Court Register (KRS) regarding an entity entered in the register of entrepreneurs or the register of associations, other social and professional organizations, foundations and independent public health care facilities.
The Ministry of Justice, which prepared the project, indicated in the regulatory impact assessment (RIA) that The mObywatel application allows users to exercise their rights in a simple way without leaving home.
“The application is constantly being developed and new services are being added to it, which necessitates the identification of new registers from which the user will be able to download data and information related to him,” the OSR stated.
How it is now
Currently, the Central Information on Land and Mortgage Registers allows you to independently print copies of land and mortgage registers, an extract from the land and mortgage registers and a certificate on the closing of land and mortgage registers via the ICT system, if an application for issuing these documents was submitted via it. Printouts of these documents have the force of documents issued by the court if they have features enabling their verification with the data contained in the central database of land and mortgage registers and may constitute a required attachment to an application submitted in electronic form to a public administration body. In such a case, however, it is necessary to attach an electronic document to the application.
The project provides that documents issued by the court would have the force of not only printouts, but also electronic documents generated by the ICT system from which these printouts are prepared.
Currently, in accordance with the Act on the National Court Register, it is possible to transmit only data of 50 entities at the same time. Obtaining data via the mObywatel application will not be limited by this limit, and the user will only be able to download data of entities with which he is associated with a PESEL number. This is intended to make it easier for users to obtain their data through one application. (PAP)
