Dziemianowicz-Bąk: Fictitious B2B means over PLN 2 billion in losses per year

Fictitious B2B, according to the Ministry of Finance, amounts to over PLN 2 billion in losses per year – says Agnieszka Dziemianowicz-Bąk, Minister of Family, Labor and Social Policy, in an interview published on Tuesday on the Wyborcza.biz website.


According to the head of the Ministry of Labor and Social Policy, “it is not too late” for regulations reforming the National Labor Inspectorate. “The work schedule on this act is indeed tight, and this is because the reform of the National Labor Inspectorate, allowing this institution to effectively transform apparent civil law contracts – the so-called junk contracts – into employment contracts, is one of the milestones of the National Reconstruction Plan,” Dziemianowicz-Bąk tells the portal. “The draft bill has already been agreed with other ministers and should soon be submitted to the Standing Committee,” he informs.
The head of the ministry was asked whether she was not afraid that the bill would be limited in the course of government work. “The entire government decided to revise the National Reconstruction Plan and include this reform in it. (…) In turn, the Minister of Finance pointed to this reform as one of the tools for closing the gap and counteracting excessive financial deficit. To put it simply, he pointed out that not only the cheated employees but also the state budget lose due to violations of labor law and fictitious civil law contracts, and the amounts run into billions of zlotys,” Dziemianowicz-Bąk points out in an interview with Wyborcza.biz.
He adds that “according to data from the Ministry of Finance, fictitious B2B alone amounts to over PLN 2 billion in losses per year.” “The entire government understands that this system simply needs to be tightened. Just as we fight the VAT gap, we should also fight the junk employment gap,” adds the minister.
In her opinion, the upcoming reform is also a “fight for the interests of honest entrepreneurs who find it difficult to compete on the market with entities that employ illegal workers or minimize costs by forcing them into fictitious self-employment and junk contracts.”
He also emphasizes that “where there is an employment relationship, there should be an employment contract.”

From January 1, 2026, the rules for determining seniority will change. The periods taken into account in its calculation will include not only full-time employment, but also running a business or performing work on the basis of a mandate contract. Importantly, the act will also cover periods from previous years – thanks to which people who have worked outside their jobs for a long time will have confirmation of their professional experience and employment rights when they decide to take up a full-time job.
