The member of the Socialist Party of the Republic of Moldova (PSRM), Vlad Batrîcea, argues that the parliamentary poll has taken place with irregularities and that the administrative resources were used.
“We cannot speak seriously about the future of Moldova, if there is neither democracy, no free elections in the country. Thus we will have neither economy, nor demographic growth, nothing will be. The choices must be correct, and the conditions of participation-gal. Only then we could talk about the functioning of democracy,” He stated for the TV8 station in the Republic of Moldova Vlad Batrîcea, the member of the PSRM Political Executive Committee, emphasizing that the magistrates of the Constitutional Court (CC) “It has to reject the validation of the elections.”
The Moldovan authorities have not yet commented on these accusations.
On Thursday, October 16, the magistrates of the Constitutional Court will meet in the meeting to confirm the results of the parliamentary elections of September 28, 2025 and to validate the mandates of the elected deputies.
Expert's opinion
And Alexandru Tanase, former president of the Constitutional Court of the Republic of Moldova and the current expert in the field of justice, stresses that the results of the parliamentary elections have been confirmed by the Central Election Commission (CEC) as legal and compliant. And the controversies related to the six mandates of the Political Party Home Democracy (PPDA) are legally unfounded because the administrative sanctions do not affect the validity of the vote.
“False dilemma of the” 6 mandates left at the Court's discretion “Controversy regarding the 6 mandates of the” Democracy “party was fueled by public speculation, not legal facts. There is no mention in the official documents of the CEC to suggest that the respective mandates would have been “left at the discretion of the Constitutional Court”. This erroneous interpretation seems to be based on the fact that the report has not been unanimously adopted. However, the CEC is a collegiate organ, and the decisions are adopted by the majority. The vote is not imperative, and the lack of unanimity does not invalidate a legal decision. About the sanctions applied to the party “Democracy Home” CEC found that in the election campaign, the Political Party “Democracy Home” violated some legal provisions. As a result, CEC applied two administrative sanctions: 1. Warning2. Suspension of the allowances from the stadium budget sanctions does not affect the validity of the elections or the assignment of the mandates. If the party does not agree with them, it can challenge the decision in court, according to the administrative litigation procedures. The law does not provide for such solutions, and the case law of the Court does not offer precedent in this regard ”, noted the expert on his Facebook page.
In the opinion of Alexandru Tanase, the Constitutional Court can invalidate the elections only in the case of serious violations that would have influenced the general result.
“The Constitutional Court can invalidate the elections only if serious violations are found that have affected the general result of the poll. In this case, it may order the repetition of the elections, with the same candidates and under the same conditions ”, he concluded.
Validated by the check
The Chisinau Electoral Authority validated the result of the parliamentary elections during the meeting on October 5, the report being transmitted to the Constitutional Court for the final validation.
In the document transmitted by the central electoral commission (CEC) to the Constitutional Court (CC), the final report of the election or the lists of the elected deputies are found.
The Action and Solidarity Party (PAS), which obtained the highest number of votes, ie 50.20%, will have 55 mandates in the future Parliament.
PAS is followed by the patriotic block that obtained 24.17% of the votes and will have 26 mandates. In the third place is the alternative block, with 7.96% of votes and eight mandates. Our party and the Political Party Democracy at home obtained 6.20%, respectively 5.62%, each to hold six armchairs of parliamentarian.
According to the legislation, the final validation of the election is to be carried out by the Constitutional Court, which has ten days to validate or invalid the result of the parliamentary elections.
