A federal judge in Oregon stopped Donald Trump's administration on Sunday to send troops of the National Guard to keep order in Portland, Oregon, a failure for the president trying to send the army to several cities, despite the opposition to Democratic leaders, reports Reuters.
The decision of the American district judge Karin Immergut came after the Trump administration's decision to call for California and Texas, just one day after it temporarily blocked Trump to send 200 Oregon National Guard soldiers to Portland.
Immergut said that there is no evidence that recent protests require the presence of national guard troops, regardless of their origin.
“How could send the California National Federal National Guard not to directly contravene (the decision) that I issued yesterday?”, Asked Immergut on a Trump Administration Lawyer during a hearing on Sunday evening.
The decision of Judge Immergut on Sunday, which will remain in force until at least on October 19, means that the Trump administration will not be able to send troops of the National Guard to Portland, while Oregon and California requests a longer term decision.
It's an abuse, says California's Democratic Governor
On Sunday, the Pentagon said that he sends 200 soldiers of the California National Guard to Oregon to “support the US immigration and customs service and other federal employees who perform official tasks, including the application of federal law, and to protect the federal property.”
The troops of the National Guard are state military forces that respond to their governors, unless they are called in the federal service. Trump has claimed that sending them to Portland is necessary to respond to protests from a city immigration center.
The governor of California, Gavin Newsom, told the judge that the troops were already on the way to Portland.
“It is an amazing abuse of law and power. The Trump administration attacks without any remorse itself,” Newsom said in a post on X.
A federal judge forbade the Trump administration to use American California troops to combat crime on September 2, but this decision is suspended because the administration appealed. As a result, the troops of the National Guard who turned to Oregon remain federalized and under Trump's command.
