Conflict between prosecutors and judges in the SCM. The first allege that their access to the ECRIS application through which they have access to the files was blocked

The section for prosecutors of the Superior Council of the Magistracy went public on Thursday with a press release in which it accuses that a decision of the CSM judge leaves prosecutors in the country who perform judicial activity without any typical means of access to files.

By that decision, from November 2025, the judges of the CSM established that “access to the ECRIS application of the courts should be configured only for the staff of the courts, the Superior Council of the Magistracy, the Judicial Inspection, the National Institute of the Magistracy and the National School of Clerks”.

“Electronic access to the file of other participants in the process is to be achieved through the electronic file”, the judges determined at the end of last year.

Prosecutors charge that the decision is “without any logical justification and without a functional alternative”

In the statement issued on Thursday, the Prosecutor's Office says that numerous prosecutor's offices notified them that they no longer have access to the courts' ECRIS application as of Tuesday, January 27. Prosecutors say that this “makes it impossible to carry out the proper judicial activity”.

“Decision of Commission No. 3 of the Section of Judges deprives prosecutors who carry out judicial activity (support indictments and other solutions before the judge, enter into civil cases, etc.) of any typical means of access to files,” they explain.

The section for prosecutors also states that “restricting the access of the Public Ministry as a representative of the general interests of society to the ECRIS application, without any logical justification and without a functional alternative, represents the expression of a misunderstanding of the role of each participant in the criminal process.”

In today's meeting, the prosecutors unanimously decided to request the restoration of the initial order and to guarantee the access of the prosecutors to the court files.
