The federal judge in San Francisco decided on Tuesday that the administration of Trump's administration to Los Angeles in response to the riots was illegal. However, the decision is not final, and the administration has time to appeal before the sentence enters into force.

As judge Charles Breyer from the District Court in San Francisco said on Tuesday, the arrangement of soldiers in Los Angeles violated the Poss Comitatus law, prohibiting the use of the army to perform the function of law enforcement agencies, except for uprising and rebellion. Breyer ordered the remaining soldiers to return to bases or limit their functions to protect federal buildings.

At the same time, he suspended the entry into force of his order until September 12, giving Trump's administration time to appeal against the judgment. The same judge, appointed by Bill Clinton, already in June issued an order to stop the distribution of troops in Los Angeles, but his decision was later changed by the Court of Appeal.

According to NBC News, there are still about 300 national guard soldiers in the city. In June, Trump sent a total of over 5,000 to Los Angeles. soldiers, both California National Guard and Marines. The testimonies and materials presented during the trial showed that the soldiers had not only protective functions – as the Trump administration claimed – but participated in police actions, detention or raids on farms and workplaces employing illegal immigrants.

The announcement of the decision is made after Trump sent soldiers to Washington as part of the fight against crime and announced similar decisions to other cities, including Chicago or Baltimore. In the case of the American capital, however, the law gives greater freedom to the federal government in the field of public security and law enforcement.
