A CSM member judge thanks the head of the Council, who said that a pension of 11,000 lei is small: they all jumped to give a fist, to take place in the picture. Did I get as low as a society?

Judge Alin Ene (39 years old), a member of the Superior Council of Magistracy, “publicly” to the head of the SCM, Elena Costache, “for assuming immense responsibility, representing the legitimate interests of the judicial system at a time of maximum tension”. He accuses “insults, invectives, dejections thrown into the public space” after Costache claimed that a pension of about 11,300 lei is insufficient, and the independence of the magistrates depends on the money.

“I am publicly thankful to the lady president of the Superior Council of Magistracy, Elena Costache, for assuming immense responsibility, representing the legitimate interests of the judicial system at a time of maximum tension, in which too few dare to speak against the current! Yes, we are not experts in public communication, we do not know what to say” It can be criticized and we have to work here ”, wrote on Monday on Facebook, Judge Alin Ene, a member of the Superior Council of Magistracy.

He says that “from here to insults, invectives, the disjections thrown in the public space in the last days to the Mrs. President is a long way.”

“The exclusive targeting of the magistrates is not accidental”

On June 29, the magistrate also posted, on Facebook, a harsh message to Prime Minister Ilie Bolojan, after he announced the project to eliminate special pensions:

“Under the mask of” reform “and resuming the same lies already disassembled by public by Superior Council of Magistracythe prime minister of Romania flagrantly violates the Constitution of Romania and the international standards, despising both the case law of the Constitutional Court and any trace of respect for the principles of the rule of law. In a challenge gesture, a new increase in retirement age is announced, an absurd increase in seniority and a brutal amputation of the service pension-all, just a few months after Law no. 282/2023 has already substantially modified these conditions.

These changes are not just abusive – they are premeditated. The exclusive targeting of the magistrates is not accidental: it is a new episode of a politically orchestrated stigmatization campaign, meant to discredit the judicial system and to control it. Who is Alin Ene

Alin Ene is a member of the Superior Council of Magistracy in 2023, until then being president of the Ploiești Court, according to his own CV posted on the CSM website.

Ene was the police officer of the Ilfov County Police Inspectorate during 2009-2011, later holding legal functions at Mangalia and Ploiești.

He graduated from the “Alexandru Ioan Cuza” Police Academy in Bucharest in 2009. He then made a master's degree at the Faculty of Law of the University of Bucharest. In 2011, he also attended the courses of the National Institute of Magistracy.

After the Government proposed that the magistrates retire at 65, and their pension is 70% of the last net salary, the president of CSM Elena Costache said she will not accept the reform package.

In an interview with Digi24, Elena Costache claimed that a pension of 70% of the net salary of a magistrate-about 11,309 lei-is insufficient and that the independence of the magistrates depends on the money.

“I should make an exact calculation, I have not done it yet. Now I will assume a direct answer-yes, it seems a little and I will tell you and why it seems a little,” said Elena Costache, “asked if she considers 70% of the last net salary as a small amount

Next, Elena Costache argued that the level of living of the magistrates is “a normal one” and that the lack of money in court would lead to the loss of the magistrates' independence.

“To look a little at all the aspects I have presented and to think first of all what kind of justice in a democratic state. Do they want to transform justice? To be a serviced justice, a justice to whom?” Costache said.

“But are we not people? How do we live? We live outside the hemisphere? We do not live? We do not drink? Our standard of living is a normal level, it is a mean level. Independent, the company has no way to work normally, ”said the head of the SCM.

Reactions in society

The statements of the head of the SCM were met with critical reactions in a good part of society.

The newspaper Cristian Tudor Popescu wrote, in a message entitled “Right right, give them money”, that the statements of the CSM chief shows that “independence in democracy, in the CSM vision, means receiving money from the state”.
