Netherlands: Three months in prison for intercourse without a condom


The crime occurred in August 2024 at a woman's house in the city of Schiedama near Rotterdam. The couple met before through the dating application. The man was to ensure that he had condoms, and the woman – as the court established – asked to use them many times. Despite this, they had unprotected intercourse.
“The accused did not respect the woman's boundaries and was guided solely by his own needs. There was a serious violation of her right to decide in what form he wanted to participate in sexual activity” – it was found in the justification of the judgment.
The man heard the sentence
It was pointed out that the woman after the incident was shocked, contacted her friend and sent a message to the accused with a description of the situation to which the man replied: “Forgive me if I made a mistake.”
According to the new law on sexual offenses, in force since 2024, you no longer need to prove physical coercion – it is enough to show that there has been action against the will of the other person. The prosecutor's office demanded six months in prison. Ultimately, the court imposed a three -month penalty and ordered to pay over 4,000 euros compensation to the injured party.
The accused, born in Tunisia, explained that he did not fully understand the woman's requests because of the language barrier. The court did not agree with this argument. The verdict is not final, and the parties have two weeks to decide on an appeal.
