The guidelines were issued in 2022, just a few weeks after the Supreme Court undermined the nationwide right to abortion in America.

It was argued at the time that hospitals – including those located in the States, where there is almost a total ban on abortion – they must carry out such procedures under the Act on emergency treatment and active childbirth (Emtala). This law requires that the emergency room financed from the Medicare program (insurance system for the poor) ensure research and stabilization to all patients.
Donald Trump's movement on emergency abortion
Trump's administration announced a departure from the enforcement of this policy. The move raised concerns among some doctors and defenders of the rights to abortion that women would not have access to life -saving treatments in the States with restrictive bans.
“Trump administration would prefer women to die in emergency rooms than to receive abortions saving lives,” said North Northup, CEO and general director of the Center for reproductive rights.
In turn, opponents of abortion expressed satisfaction with Washington's decision. Marjorie Dannenfelser, president of the SBA Pro-Life America, commented that Era Biden's policy “was a way to expand access to abortion in the states in which she was forbidden.”
