Cristi Danileț: A court cannot suspend or undo a CCR decision

The National Institute of Magistracy must make special sessions for the training of the magistrates in administrative and constitutional law, says the former judge Cristi Danileț after the decision of the Ploiești Court of Appeal to suspend and annul the RCC decision to annul the presidential elections.
“A court cannot suspend or annul a CCR decision. Of course, if we decide otherwise we have to deal with a judicial aberration, which produces the following consequences:
– the respective judge risks being disciplinary investigated for the bad faith application;
– its solution will be corrected by the ICCJ;
– INM must make special sessions for the training of magistrates in administrative and constitutional law, ”wrote on Facebook Cristi Danileț.
Breaking the Ploiești Court of Appeal decided to suspend and annul the RCC decision regarding the annulment of the elections. The decision is not final. “It is an aberration, you cannot annul a decision of the RCC, because it is not an administrative act”
