The online optics store lensa.ro, fined after a person claimed to receive unsolicited commercial offers by SMS

The Tensa Art Design, the company that operates the online optics store www.lensa.ro, was fined 15,000 euros for transmitting by SMS by unsolicited commercial offers (so -called spam on mobile), the Authority for Personal Data Protection announced on Thursday. It all started from the complaint of a person who accused that the company did not respond to applications to cease this practice.
The investigation was started as a result of the fact that a petitioner notified the National Supervisory Authority regarding the fact that the operator Tensa Art Design SA, holder of the website www.lens.ro, processed his phone number, for direct marketing, without his consent, communicating to him by the SMS type through which the petitioner was informed about the company.
During the investigation, the authority also found that the company that owns lensa.ro did not have the permission of the respective person for the use of personal data for direct marketing purposes, thus violating the provisions of art. 6 Ali. (1) letter. a) of the EU Regulation on Personal Data Protection (GDPR).
In addition, the operator did not properly manage the requests by which the petitioner exercised his rights of access and deletion of personal data, as he asks for the same European Regulation.
Beyond the fine, the authority has also imposed on the company a series of corrective measures such as: training the employees in compliance with the legal obligation that any transmission of commercial messages by SMS or e-mail should be carried out only after obtaining the agreement of the persons concerned, the obligation to respond in writing to the applicants' requests and other technical measures.
