The Bucharest Court published the reasons for the decision by which gave a win of cause to the Antena press group in one of the trials with Sorin Bontea, forcing the former television star to pay 100,000 euros, he writes Media Page.
The court motivates its decision – which is not final – by the fact that Sorin Bontea violated a contractual clause, which stipulated that Bontea should not advertise certain brands without Antena's consent, according to Pagina de Media.
Antena Group claimed in the process that the former juror of the show Chefi la Cuțite made 48 online posts to advertise or promote products that were not related to the trust, thus violating a contract signed with the television in 2017. According to Pagina de Media, the contract stipulated that the trust must give its consent in writing, if Bontea wanted to participate in other shows or advertise for other brands, an agreement that did not exist. The ads were made during 2022-2023.
In the process, the chef Sorin Bontea defended himself saying that “the notion of “online materials” would be a vague, imprecise one, without establishing beyond any reasonable doubt the defendant's obligation to refrain, citing the fact that his posts would not meet the conditions of Article 5.11 of the Contract, but of other contractual clauses”, according to the quoted source.
However, the court rejected Bontea's arguments, reasoning that the terms of the contract were clear and the clause was negotiated between him and the Antena trust. “The limitation of freedom of expression by contract is legal, if it is assumed voluntarily”, is one of the arguments of the court.
The decision of the Bucharest Court of April 17 is not final and can be appealed.
