The District Court in Łódź wants to transfer to another court the request of a “coffins on wheels” lawyer to serve a 1.5-year prison sentence under electronic monitoring. The Supreme Court will decide who will finally hear Paweł K.'s case.

In March, the defense attorney of Paweł K., who was sentenced by the District Court in Olsztyn to 1.5 years in prison, submitted to the court in Łódź an application for the possibility of serving his sentence under electronic monitoring. He was brought to the court in Łódź due to the place of residence of the convict.

However, the application has not been considered so far because the District Court in Łódź asked the Supreme Court to transfer the case to another institution due to the “good of justice”.

– The court in Łódź, maintaining all standards and wanting to avoid any speculations related to the fact that Paweł K. was an attorney active in the Łódź district, would like the Supreme Court to transfer this case to another court – the spokesman for the Court of Appeal in Łódź, Judge Grzegorz Gała, told PAP on Wednesday.

If the Supreme Court does not accept the application, this will mean that the case will be examined by the Court of Appeal in Łódź.

Earlier, the Łódź court refused to allow the lawyer to suspend the execution of the sentence. Currently, Paweł K. is suspended from professional activities.

As the spokeswoman of the District Bar Council in Łódź told PAP, attorney Justyna Cheda-Onisk, after obtaining the justification for the final judgment, the case of the convicted lawyer will be dealt with by the Council's disciplinary spokesman.

She indicated that the basis for deleting a lawyer from the list of lawyers by the ORA is the loss of public rights or the right to practice the profession pursuant to a court judgment.

– The basis for expulsion may also be the disciplinary court's imposition of a penalty of expulsion from the bar. The mere fact of a final conviction does not result in an automatic decision to exclude one from the ranks of lawyers, she added.

Pursuant to the regulations, the court may order a prison sentence under electronic monitoring if the prison sentence does not exceed one year and six months and there are no obstacles to its application.

To take advantage of the possibility of serving a prison sentence outside a prison, the convict must have a permanent place of residence, and if adults live with him, they must consent to this method of serving the sentence. Technical conditions for supervision of the convict must also be met. It's about the number and range of available transmitters and recorders.

Paweł K. March 5 this year He was legally convicted of causing an accident in which two women died. The District Court in Olsztyn commuted the judgment of the court of first instance (in April 2025, Paweł K. was sentenced to two years in prison and a five-year driving ban) and sentenced Paweł K. to one year and six months in prison and a four-year driving ban.

The accident occurred in September 2021 on the Barczewo – Jeziorany road. According to the indictment, Paweł K., while driving a Mercedes, violated the safety rules in land traffic, crossed the double solid line and drove into the opposite lane. He caused an unintentional road accident – a collision with an Audi 80 traveling from the opposite direction. As a result, the driver and passenger of the Audi died on the spot.

The fatal road accident near Barczewo became famous when, shortly after it, Paweł K. recorded and published a video of his statement on the Internet. He stated that the accident was a confrontation between a safe car and a “coffin on wheels” and, among other things, that's why these women died. The statement posted on social media outraged public opinion. (PAP)
