The court revokes the EAW for Marcin Romanowski. Minister Żurek criticizes the decision


Judge Anna Ptaszek, spokeswoman for criminal matters of the District Court in Warsaw, announced the annulment of the EAW against Romanowski. The politician's defense, represented by attorney Bartosz Lewandowski, argued that the actions of law enforcement agencies in this case bore signs of political pressure and violated constitutional civil rights.

Żurek criticized the court's decision, pointing out that it was made “in a closed session, without the knowledge or notification of the prosecutor's office.” In his opinion, the justification for the decision is internally contradictory, and the court had previously had access to information that it now considered “new and fundamental”.
Political asylum and prosecutor's charges
Marcin Romanowski, who was granted political asylum in Hungary in December 2024, is suspected of involvement in irregularities related to the Justice Fund. The prosecutor's office accuses him of, among other things, operating in an organized criminal group and rigging competitions financed from the fund.
The prosecutor's office believes that the EAW is necessary to enable procedural activities to be carried out with Romanowski's participation. “The suspect fled abroad and is hiding, which makes it impossible to bring charges against him” – said Prosecutor Przemysław Nowak, spokesman for the National Prosecutor's Office.

The court's arguments and the prosecutor's reaction
When revoking the EAW, the court referred to the provisions of the Code of Criminal Procedure, which require that the issuance of the order be necessary from the point of view of the interests of justice. The justification included, among others: on Hungary granting Romanowski refugee status and Interpol's refusal regarding the so-called red note.
The prosecutor's office rejects these arguments, emphasizing that this information was already known and does not constitute grounds for revoking the order. “Circumstances such as the granting of political asylum or the Interpol decision do not change the fact that the EAW is necessary.” – added Nowak.

Romanowski comments. “It's an indictment against the government”
Romanowski himself, commenting on the court's decision on Telewizja Republika, said that it was an “indictment” against the management of the Ministry of Justice and the entire ruling team. According to him, the Justice Fund issue was to be used by the current government to attack PiS politicians.
Romanowski, who after obtaining asylum in Hungary declared that his mission on the Danube was to fight “lawlessness”, remains at the center of one of the most high-profile investigations in recent years. In February, the Sejm revoked his immunity and consented to his detention, and the Warsaw district court upheld the decision to arrest him.
The prosecutor's office announces that it will not abandon the case. If the repeated application for an EAW goes to the same judge, Romanowski announced he would submit a request to exclude it due to “lack of objectivity”.
