On Thursday, June 4, President Nicușor Dan appointed Eugen Tomac for the position of Prime Minister, who has ten days to obtain the necessary parliamentary support to form a majority and invest the new Government.

However, if he becomes prime minister, Tomac must give up his capacity as a member of the European Parliament, otherwise he would be incompatible.

According to art. 9 of Law 33/2007, which establishes the legal framework for the organization and conduct of European parliamentary elections “the capacity of a member of the European Parliament is incompatible with the capacity of a deputy or senator in the Romanian Parliament, a member of the Romanian Government, with the functions provided for in art. 81 and 82 of book I title IV chapter. III section 2 of Law no. 161/2003 regarding some measures to ensure transparency in the exercise of public dignities, public functions and in the business environment, the prevention and sanctioning of corruption, with subsequent amendments and additions, or with equivalent functions in the member states of the European Union”. writes Mediafax.

The same law states that “if a case of incompatibility with the functions provided for in art. 81 and 82 of book I, title IV, chapter III, section 2 of Law no. 161/2003, with subsequent amendments and additions, appears or continues to exist, the persons found in incompatibility are considered to have resigned from the position of European parliamentarian. The resignation is confirmed by decision of the Permanent Electoral Authority”.

In the period 2012-2019, during the Băsescu administration, Eugen Tomac was twice a deputy in the Romanian Parliament. The first time, for the Diaspora, the second time in the Bucharest constituency.

But, according to the legislation in force, the advantages of Eugen Tomac's presence in the European Parliament are not few:

  • An MEP earns a net salary of around €7,854 per month, which is supplemented by administrative allowances, daily allowances and transport allowances
  • Gross salary: 075.18 euros per month. It is set at 38.5% of the basic salary of a judge at the Court of Justice of the EU
  • General expenses allowance: 950 euros per month. This money is intended for office activities (rent, computers, telephones, internet). The amount is halved if the deputy does not attend at least half of the plenary sessions in a year without reason
  • The daily allowance for the European Parliament is 350 euros per day. It is granted to cover accommodation, meals and other related expenses on days when the MEP attends official activities in Brussels or Strasbourg. It is halved if the deputy is absent from the roll call votes on plenary days
  • The Parliament fully settles the cost of plane tickets (business class) or train tickets (1st class) for official travel related to parliamentary activity.
  • Staff budget: Approximately 000 euros per month allocated to pay accredited and local assistants. This money does not enter the MEP's personal account, but is managed directly by the Parliament's administration.

The European Parliament established that former MEPs are also entitled to an “old age pension starting at the age of 63”. The pension represents 3.5% of the basic salary for each full year of the mandate, without the total amount exceeding 70% of the basic gross salary.
