The court returned the land in a popular vacation spot near Krasnoyarsk to federal ownership

Following a claim by the prosecutor's office of the Krasnoyarsk Territory, 5 hectares of land were returned to federal ownership at the Esaulovskaya loop.

It was established that in 2016 the administration of the Barkhatovsky village council leased a plot in close proximity to the bank of the Esaulovka River. Later, the tenant registered ownership of a transformer substation with an area of 25 square meters allegedly located on it. m. and, citing this, bought the entire plot at a discounted price – for only 15% of the cadastral value.
“The prosecutor's investigation showed that there were in fact no real estate objects on the site, the ownership of the substation turned out to be registered on the basis of forged documents, and the site itself also crossed the river bank, that is, it belonged to federal property, which local authorities had no right to dispose of. The proportionality also looked especially expressive in this scheme: almost 50 thousand square meters of land for an object of 25 square meters. In other words, for every square meter of the ghostly substation there was so much land, as if it was not a technical structure, but at least a strategic center for managing the landscape,” the supervisory agency said.
The court granted the claim to reclaim the site from someone else's illegal possession – as a result, the picturesque bend of the coast near the Esaulovskaya Loop was returned to federal ownership.
And the purchaser of the plot was found guilty of fraud (Part 3 of Article 159 of the Criminal Code of the Russian Federation) and sentenced to 3 years of suspended imprisonment.
