Nicusor Dan, three decisions in one day. Announcements made by the Presidential Administration

President Nicușor Dan attacked at CCR the law that establishes prevention and intervention quotas for bears, appointed a new state councilor and promulgated a law, the Presidential Administration announced on Thursday afternoon.

Thus, Nicușor Dan notified the Constitutional Court regarding the law that doubles the number of bears that can be killed in a year. Reasons cited: the form of the law adopted by the Parliament does not respect the Constitution, the law of the European Union, nor the jurisprudence of the Court of Justice of the European Union regarding the protection of strictly protected species.

In the notification sent to the CCR, the head of state states that the number of brown bear specimens that can be hunted for intervention – 110 bears – is not justified, unless it is demonstrated that the brown bear population is “excessively numerous and that other solutions to preserve the ecological balance and safety of the population are not sufficient”.

“In other words, the Habitats Directive imposes a verification of the fact that there are no satisfactory alternatives before proceeding to the elimination of bears, and the obligation to comply with this condition does not appear explicitly in the criticized law, which, moreover, seems to partially transform a special derogation into a normative mechanism, likely to contravene the principle according to which derogations must be temporary exceptions, justified on a case-by-case basis,” the president's report shows.

He also invokes a decision of the Court of Justice of the EU, which established in Case C-674/17 that “by establishing automatic “prevention quotas” (no. 859 bears according to the law), through the law deduced from the constitutional control, the mandatory “case by case” analysis is eliminated and the priority application of non-lethal methods to eliminate human-bear conflicts is ignored, exposing Romania to a procedure of imminent infringement”.

Also, Nicușor Dan draws attention to the fact that the law does not respect the separation of powers in the state. The President conveys that the Ministry of the Environment, not the Parliament, should have been responsible for adopting the decision regarding the intervention quotas and the prevention quotas for brown bears.

He criticizes the lack of sanctions for killing bears with cubs

In addition, the head of state also criticizes the fact that the law does not provide any penalty for those who hunt females with cubs under 2 years old, which is prohibited by law.

“The ban on harvesting females accompanied by cubs under the age of 2 is incompletely regulated. The law does not specify the procedure for determining the age of the cubs, the person responsible for the finding, the legal consequences of the identification error, the evidence regime and the special sanction for violating the ban within the preventive harvesting mechanism”, Nicușor Dan also states.

At the same time, he also criticizes the fact that although the number of brown bear specimens that represent the prevention quota – 859 – cannot be monitored, which “makes compliance with the established ceiling impossible. In the absence of a mechanism to automatically block the extraction of bears once the number related to a hunting fund has been reached, it is implicitly allowed to exceed this number”.

CCR judges set the first court date for this law on June 24.

A new councilor at the Cotroceni Palace

Nicușor Dan also signed a decree “for the appointment of Mr. Radu-Ioan Mogoș to the position of state councilor, starting on May 25, 2026”. The official statement does not specify the department in which Mogoș will work, but sources from the Presidential Administration explained to HotNews that he will deal with digitization, artificial intelligence and new technologies.

According to a CV published on the website of the Academy of Economic Studies (ASE), Radu-Ioan Mogoș is a doctoral university lecturer at the Faculty of Cybernetics, Statistics and Economic Informatics within the ASE at the Department of Informatics and Economic Cybernetics.

Mogoș received his degree at the Polytechnic University of Bucharest, Faculty of “Electronics, Telecommunications and Information Technology”, specialization “Multimedia and HiFi”. In parallel, he also studied economics, majoring in “Informatics” at ASE, at the “Cybernetics, Statistics and Economic Informatics” Faculty, where he also obtained a bachelor's degree.

He graduated two master's degrees at ASE, one in “Business Relations and Communication” and the second in “English Communication for Teaching and Economic Research”.

Between 2005 and 2008, he attended the doctoral school within ASE, and he defended his doctoral thesis in 2011, the title being “Technologies, information and communication systems, for economic activities, business development, services and transports”.

Enacted law allowing inmates to participate via video conference in trials

Also today, Nicușor Dan promulgated a law initiated by PNL parliamentarians which stipulates that a prisoner who is “in detention or interned in an educational center is brought to trial only when the court so orders”.

The same law provides that, in case the court “does not order to be brought to trial, it ensures the participation of the convicted person by means of video conference, at the place of detention or internment, in the presence of the defender elected or appointed ex officio and, as the case may be, the interpreter.”

The end of the first round of consultations

Also today, Nicușor Dan concluded the first round of consultations at the Cotroceni Palace regarding the appointment of the future prime minister. He received the parliamentarians from the PACE and UPR groups, respectively the unaffiliated ones. The first round ended without a designation, with consultations expected to resume the following week.
