Project adopted by the Senate: Providers of electronic communications services, obliged to issue invoices at the BNR rate

Providers of networks or electronic communications services intended for the public that conclude contracts in euros or in another foreign currency will have the obligation to issue invoices in lei at the exchange rate of the National Bank of Romania, without the application of margins, additions or additional commissions, according to a draft law adopted on Monday by the Senate.
The legislative proposal amends and completes the Government's Emergency Ordinance no. 111/2011 on electronic communications, writes Agerpres.
“In the case of contracts whose price is expressed in euros or in another foreign currency, the providers of electronic communications networks or services intended for the public have the obligation to inform the end users, prior to the conclusion of the contract, that the invoices will be issued in lei, at the exchange rate communicated by the National Bank of Romania for the working day preceding the date of the invoice, published at 1:00 p.m., without the application of margins, additions or additional commissions”. stipulates the normative act.
At the same time, according to the draft law, “providers of electronic communications networks or services intended for the public that conclude contracts whose price is expressed in euros or in another foreign currency have the obligation to issue invoices in lei, at the exchange rate communicated by the National Bank of Romania for the working day preceding the date of issuing the invoice, published at 1:00 p.m., without the application of margins, additions or additional commissions”.
Failure to comply with this obligation will constitute a contravention, which is ascertained by the control staff within ANCOM.
The Senate is the first legislative forum referred to, and the Chamber of Deputies is decision-making.
