During the second reading of the bill suspending the sale of state land, MPs introduced amendments. The bill was therefore referred back to the Agriculture Committee for consideration. The proposed regulations assume a suspension of the sale of state land until 2036.


The amendments were submitted by the PiS Club, the PO Club and the President of the Republic of Poland. The amendments concern the new wording of the preamble to the act and the PSL amendment submitted during the first reading of the draft at the meeting of the Parliamentary Committee on Agriculture regarding the possibility of selling land up to 5 ha (it was up to 2 ha) with the consent of KOWR, but without the consent of the Minister of Agriculture, which is intended to improve the decision-making process.
Those opposed to the PSL amendment were, among others, PiS MPs, who pointed out that it facilitates the sale of land and, moreover, goes beyond the amended provisions of the Act on suspending the sale of real estate from the Agricultural Property Stock of the State Treasury and amending certain acts of 2016.
The current provision of the Act reads – “for a period of 10 years from the date of entry into force of the Act, the sale of real estate, parts thereof and shares in co-ownership of real estate included in the Agricultural Property Resource of the State Treasury shall be suspended.” The provision does not apply to the sale of agricultural properties with an area of up to 2 ha.
Deputy Minister of Agriculture Jacek Czerniak, answering MPs' questions, informed that the resignation from the consent of the Minister of Agriculture, in accordance with the PSL amendment, would shorten the decision-making time by 6 months. He emphasized that these lands are sold to individual farmers.
“In the years 2016 – 2025, applications for consent to the sale of agricultural property between 2 ha and 5 ha accounted for 35 percent of all applications, but concerned only about 5 percent of the total area of the property. In total, there were 408 such applications out of a total of 1,185,” the deputy minister calculated.
During the second reading, the MPs referred to the presidential bill “amending certain acts to protect Polish agriculture”, one of the three bills that was selected as the leading bill during the first reading. The presidential, government and PiS projects were similar, all of them assume a ban on the sale of state land until 2036, i.e. for another 10 years. Currently, until April 2026, there is a ban on selling land from the State Treasury. The preferred form of land use is leasing. (PAP)
