“Sportmaster” did not return the Krasnoyarsk resident almost 87 thousand rubles remaining on the gift card

A resident of Krasnoyarsk complained to Rospotrebnadzor about a violation of his consumer rights in the large chain of stores “Sportmaster”, where he “burned” the unused balance of money from a gift card because he I did not pay for the full amount.

The man was given a “Sportmaster” card with a face value of 100,000 rubles by his wife. In a store in the Mega shopping center, he chose goods worth 13,070 rubles, paid with a card, and it was taken away from him along with the balance of 86,930 rubles. A written complaint demanding the return of this money from Krasnoyarsk was refused, motivated by the fact that the gift card can only be used once.
The man went to court and Rospotrebnadzor to protect his rights. Department specialists examined the seller’s website and indeed found the following conditions: “The gift card can only be used once. If the purchase price is less than the value of the gift card, the balance will not be paid in cash.” It was also stated that a gift card is used when receiving goods and services only once, regardless of the size of its denomination, but the buyer can use the remaining amount to choose something else from the range of stores in the network, in addition to the main purchase.
“It turns out that the gift card bearer is actually forced to either purchase unnecessary goods or purchase goods at a higher price than the price set for an indefinite number of people. Such conditions obviously infringe on the rights of consumers and are unacceptable. An interesting detail: the rules for purchasing and using Sportmaster gift cards posted on the website do not contain the specified conditions,” Rospotrebnadzor said.
Based on the identified violations of the law, the Department issued a warning to Sportmaster LLC. And to restore the buyer’s rights, specialists are ready to join the legal process and provide the necessary assistance in defense.
