President Karol Nawrocki announced on Tuesday that he had sent a letter to Prime Minister Donald Tusk demanding that the EU agreement with the Mercosur countries be immediately appealed to the Court of Justice of the European Union.

“I am sending a special letter to Prime Minister Donald Tusk demanding an immediate complaint against the European Union agreement with the Mercosur countries to the Court of Justice of the European Union. The government promised this. To this day it has not fulfilled this promise. The countryside cannot wait any longer. I am attaching a ready draft of such a complaint to the letter. Everything is ready. All you need to do is act. We must use all avenues and possibilities to stop the agreement with Mercosur,” the president said in a recording posted on social media.
Representatives of the European Union and Mercosur countries on January 17 this year. signed a partnership agreement and an interim trade agreement. The majority of the EU Council agreed to this on January 9, with the opposition of Poland, France, Ireland, Hungary and Austria. The partnership agreement still needs to be ratified by all EU member states.

Prime Minister Tusk informed at the end of March that the government does not plan to file a complaint to the CJEU regarding the agreement with Mercosur for now. He recalled that the complaint had already been submitted at the request of the European Parliament. What's happened so far?

The Sejm indicated that Member States may bring a complaint for the invalidation of an act of the European Union, alleging lack of competence, violation of essential procedural requirements, violation of the Treaties or any legal rule related to its application, or abuse of power.
Earlier, in February, the President of the European Commission, Ursula von der Leyen, announced that the EC would begin the provisional application of the trade agreement. Under the EU treaties, the agreement can only be fully concluded once the European Parliament has given its consent. However, the trade agreement will be provisionally applied from May 1 this year. with all countries that complete their ratification procedures and have notified the Community thereof before the end of March.
This means that from May it will be possible to import products such as beef, poultry, dairy products, sugar and ethanol into the EU at more favorable customs rates for South American producers. However, such a reduction will only apply to the quantities of a given product specified in the contract. In return, Mercosur countries will reduce tariffs on European industrial goods, including cars, which are in many cases prohibitive.
The provisions of the agreement in the part relating only to trade will apply, as this is the competence of the European Commission. In practice, this means the immediate abolition of customs duties and trade barriers. Other issues will remain pending until full ratification, such as investment protection and public procurement. In this case, ratification by the European Parliament and the Member States will be needed.
From May 1 this year the so-called a protective clause to the agreement, which is intended to respond to the concerns of farmers who anticipate an excessive inflow of Mercosur products to the EU. It will be activated if the prices of a given product in the EU drop by 5% as a result of imports from Mercosur. It will then be possible to increase customs duties on a given product or introduce an import ban into the EU. (PAP)
