A resident of the Krasnoyarsk Territory has been suing a marketplace for more than two years over an imposed product.

Specialists from the Krasnoyarsk Rospotrebnadzor helped a resident of the village of Podgorny return the money for the imposed dietary supplements and sue Wildberries for compensation for violation of rights when issuing an order at the point of delivery.

It all started back in 2023. The woman placed an order for several products with payment upon receipt. Arriving at the pick-up point, she decided to refuse dietary supplements, but the employee still wrote off the money for them.
The buyer sent a claim to Wildberries LLC demanding to accept the goods and return the payment, but was refused. It was argued that food products of proper quality cannot be returned once they are received by the buyer.
The woman turned to Rospotrebnadzor to protect her consumer rights, and a lawsuit was filed against Wildberries LLC. The litigation lasted more than two years.
“The court of first and appellate instances refused to satisfy the requirements, not recognizing Wildberries LLC as the subject of legal relations between the seller and the buyer. This is despite the Department’s arguments that the marketplace did not provide full information about the seller (his location), thus depriving the consumer of the opportunity to make a claim. At the same time, it was the pick-up point employee who unlawfully wrote off the funds when there was a refusal of the goods. I had to go to the Eighth Court of Cassation. In his ruling, he overturned the decisions of the lower courts, finding violations in them, and sent the case for a new trial to the appellate court. At the end of January this year, justice triumphed. The claims were satisfied by the appeal ruling of the Sovetsky District Court,” Rospotrebnadzor said.
As a result of the proceedings in favor of the woman, more than 15,000 rubles were recovered from Wildberries LLC: 3,607 rubles – the cost of the goods, 5,000 rubles – compensation for moral damage, 5,102 rubles – a fine, 1,598 rubles – interest for using other people's money. After receiving the funds, the buyer must, upon request and at the expense of the seller, return the imposed dietary supplements. The court's decision entered into legal force.
