The new regulations provide for the introduction of maximum prices for gasoline and diesel oil and the possibility of temporarily reducing excise duty.
The first act assumes the introduction of official maximum prices. They will be calculated according to a specific formula, including:
- average wholesale price of fuels on the domestic market,
- excise duty,
- fuel surcharge,
- sales margin (PLN 0.30 per liter),
- VAT.
The price will be announced by the Minister of Energy in the form of an announcement and will come into force on the day following its publication. In the case of publication before holidays – until the next business day.
Importantly, the adopted amendment assumes that this will be the case maximum priceso sellers will be able to offer fuel cheaper.
Sales above the established limit will be subject to a fine of up to PLN 1 million, and inspections will be carried out by the National Tax Administration.
Excise duty reduction possible by regulation
The second act gives the Minister of Finance the possibility of temporarily reducing excise duty on fuels by way of a regulation. As indicated, this decision is to be made in response to the market situation, in particular the effects of the conflict in the Middle East.
According to Prime Minister Donald Tusk's announcement, excise duty could be reduced to the EU minimum:
- by 29 groszy per liter of petrol,
- by 28 cents per liter of diesel fuel.
Package before Good Friday
The government announces that the new regulations will come into force very soon – before Good Friday, which falls on April 3 this year.
Deputy Minister of Finance Jarosław Neneman announced that draft regulations reducing VAT and excise duty are already ready, but their implementation requires an appropriate statutory basis.
Fast legislative track
Both bills will now reach President Karol Nawrocki's desk. According to the Prime Minister's declaration, they are to be adopted by the Parliament on the same day and sent to President Karol Nawrocki's desk.
The new regulations are to enter into force the day after they are announced.
