The ex-head of the Krasnoyarsk FMBA was unable to challenge the verdict of embezzlement of 15 million rubles

In Krasnoyarsk, the court rejected the complaints of the former director of the Krasnoyarsk branch of the Federal Siberian Scientific and Clinical Center of the FMBA of Russia and his defenders against the verdict of embezzlement of more than 15 million rubles, the prosecutor’s office reported.

The department recalled that the court of first instance found that from 2019 to 2021, a scheme for fictitious supply of drugs was operating in the medical institution. The actual volume and nomenclature of what was supplied to the center did not correspond to the papers. Some of the drugs were used for medicinal and cosmetic purposes, including outside the walls of a medical institution. As a result, 15 million budget rubles were wasted. The organizers were the ex-head of the medical institution, his wife – deputy for extra-budgetary and insurance activities, a representative of the medicine supplier and the head of the hospital pharmacy.

The court examined all the evidence of the parties and found the ex-head of the center guilty of embezzlement on an especially large scale (Part 4 of Article 160 of the Criminal Code of the Russian Federation). He was punished with 6 years of imprisonment to be served in a general regime colony. In addition, a fine of 700 thousand rubles was imposed. The court sentenced the representative of the supplier company to 4 years of suspended imprisonment with a probationary period of 3.5 years. The civil claims were satisfied: in favor of the TFOMS in the region – 13.5 million rubles, in favor of the medical institution – 260 thousand rubles.

“To ensure the execution of the sentence in terms of additional punishment in the form of a fine and civil claims, the arrest of the ex-director’s property has been maintained: money in the amount of 900 thousand rubles, a Lexus RX350 car, 2 residential and 3 non-residential buildings. The pharmacy manager previously entered into a pre-trial agreement with the prosecutor and was convicted in 2024 under a special procedure. The criminal case against the wife of the ex-manager has been separated into separate proceedings,” the prosecutor’s office explained.

In appeals, the defense argued that the guilt of the convicted person had not been proven, and asked to overturn the verdict and acquit the ex-director of the institution.

The panel of judges found no grounds for this. The court indicated that the conclusions about his guilt are based on the totality of the evidence examined, and the defense’s arguments boil down to a reassessment of the circumstances, which have already been given a proper legal assessment by the court of first instance.
