The ex-director of the Krasnoyarsk Business Development Agency was acquitted of charges of embezzlement of budget money

The court found Alexander Gramatunov, who headed the Business Development Agency of the Krasnoyarsk Territory and then the regional network of My Business centers, not guilty of embezzlement of budget funds. In November 2023, the prosecutor's office reported that the court sentenced the head of the regional agency to 3 years of probation for taking 6 million rubles from the organization's account and repaying his personal loan with it. Within 1.5 years this amount was returned. Despite this, investigators opened a criminal case of misappropriation (Part 4 of Article 160 of the Criminal Code of the Russian Federation).
Alexander Gramatunov’s lawyers filed an appeal and proved that the ex-head of the agency had no intention to steal money. The transfer of money was officially formalized, the funds were returned on time and in full to the organization long before the initiation of a criminal case.
As a result, the sentence against Alexander Gramatunov was overturned; acquitted due to the absence of corpus delicti in his actions. The seizure of his property has been lifted. The court also recognized the right of the ex-head of the agency to rehabilitation.
The prosecutor's office tried to challenge this decision in the Eighth Court of Cassation of General Jurisdiction, but it only confirmed the correctness of the decision made by the Judicial Collegium for Criminal Cases of the Krasnoyarsk Regional Court.
