CSM resumes voting on Monday for Alex Florența and Marius Voineag, in whose case an unprecedented situation arose / Interview for the candidate for DNA leadership

The section for prosecutors of the Superior Council of Magistracy (CSM) resumes voting on Monday in the case of Alex Florența, who is running for the post of deputy head of DIICOT, and Marius Voineag, who is running for the position of deputy prosecutor general, reports Agerpres.

Alex Florența (the current general prosecutor) and Marius Voineag (currently the head of the DNA) did not want to run for a second term, but opted for second-rank positions.

They held interviews at the CSM on Wednesday and Thursday, but failed to obtain a favorable majority in the Council, both receiving three votes “for” and three “against”.

The equality of votes, in the case of prosecutors Marius Voineag and Alex Florenta, is unprecedented.

The vote will be resumed on Monday, without the two answering the questions of the CSM prosecutors.

Voineag explained during the CSM interview on Thursday why he no longer wants “a number one position”.

On Monday, the proposal for the headship of the DNA holds the interview

Ioan Viorel Cerbu, selected by the Minister of Justice, Radu Marinescu, for the position of chief prosecutor of the DNA, is also scheduled for Monday.

So far, out of five candidates heard at the CSM, only Codrin Horatiu Miron managed to obtain a favorable opinion for the position of head of the Directorate for the Investigation of Organized Crime and Terrorism.

Instead, Cristina Chiriac – proposed for the position of general prosecutor and Gill-Julien Grigore-Iacobici – for deputy chief prosecutor of DIICOT received a negative opinion and Alex Florența and Marius Voineag – a runoff.

According to the law, the Section for Prosecutors of the CSM issues a reasoned advisory opinion, after which the proposals made by the Minister of Justice, Radu Marinescu, are submitted to the President Nicusor Dan.

In the case of issuing a negative opinion of the Section for Prosecutors of the CSM, the Minister of Justice organizes a new exclusive interview with the candidate who received a negative opinion and following this interview, the Minister of Justice can continue the procedure by sending to the President of Romania the proposal for appointment to the management position, accompanied by all the relevant documents, or withdraw the proposal, triggering a new selection procedure in a maximum of 60 days.

The President of Romania can refuse, with reasons, the appointment to management positions, making the reasons for the refusal known to the public. The president's decree of appointment or his reasoned refusal is issued within a maximum of 60 days from the date of transmission of the proposal by the Minister of Justice.
