

We are talking about government bill No. 12353, which regulates the issue of mandatory evacuation of children without parental consent. The Verkhovna Rada adopted the document as a law in the second reading on February 10.
According to human rights activists, they consider it necessary to regulate the procedure for evacuation, in particular of children, in the conditions of the war that the aggressor country of the Russian Federation is waging against Ukraine. At the same time, the signatories emphasize that, in their opinion, the document adopted on February 10 de facto introduces a mechanism for the “forced” evacuation of the entire civilian population without sufficient legal guarantees and may violate human rights and international humanitarian law.
The statement states that the hypothetical benefits of introducing the proposed procedure are offset by the risks that accompany all stages of its implementation. Human rights activists note that the law connects forced evacuation with the needs of combat operations and the development of defense structures. This, they say, creates preconditions for the use of housing, land and other property of civilians.
In addition, the document sees risks of disproportionate interference with the right to respect for private and family life. Human rights activists warn that the law allows for the militarization of the humanitarian evacuation procedure and creates legal uncertainty regarding the grounds and procedure for its implementation.
The appeal was signed by the NGO “Understanding the Crisis”, the Charitable Foundation “East SOS”, the Charitable Foundation “Right to Protection”, the Human Rights Center ZMINA, the NGO “Donbass SOS”, the Charitable Foundation “Stabilization Support Services”, the Crimean Human Rights Group, the NGO “Public Holding “Influence Group” and the NGO “Crimea SOS”.
