Criminal complaint against Ilie Bolojan. The prison unions accuse him of abuse of office

The penitentiary unions announced on Wednesday that they have filed a criminal complaint against Prime Minister Ilie Bolojan, whom they accuse of abuse of office in connection with the adoption of the administration reform project.

According to the trade unionists, the complaint concerns the adoption, in bad faith, of the project regarding the reform of the administration, “while the prime minister was aware that the Ministry of Development, Public Works and Administration (MDLPA) developed the project without legal and constitutional competence”.

The Federation of Trade Unions from the National Administration of Penitentiaries (FSANP) also says that the normative act directly affects fundamental rights, namely the right to pension, the right to work, the right to free movement, the right to property, the right to the protection of disabled people, the right to the protection of children and the right to a decent standard of living, as well as fundamental state institutions. In addition, the draft contains provisions that interfere with regulations on state military pensions, with a direct impact on prison officers.

The unionists accuse the prime minister of not taking into account the institutional opinions, citing the positions of the Legislative Council, the Economic and Social Council, as well as the observations made by the Ministry of Labour, Family, Youth and Social Solidarity and the Ministry of Finance.

“Despite all these institutional warnings from specialists, the project was promoted and assumed at the governmental level,” the press release also states.

According to the unionists, Ilie Bolojan “knew, but deliberately ignored, the violation of the constitutional limits regarding the adoption of emergency ordinances, including the prohibition to affect fundamental rights and freedoms through the GEO, as well as exceeding the legal powers of the initiating ministry, in this case, the MDLPA”.

Also, the trade union organization announces that it will constitute a civil party, requesting moral and material compensation for the damage suffered by limiting legitimate rights.

Bolojan: “There are provisions that respect the Constitution”

The members of the Government adopted, on Tuesday evening, two emergency ordinances, one of which concerns the reform measures of the local and central public administration, and the other economic recovery measures. One of the main points of the ordinance aimed at reforming the administration is related to the reduction of the number of positions in the local administration

Prime Minister Ilie Bolojan announced, on Tuesday evening, at the end of the Government meeting, that the provisions contained in the two normative acts regarding the reform of the administration and the economic recovery package respect the Constitution and specified that they were adopted without any comments and there were favorable opinions from all the ministries.

“There are provisions that respect the Constitution, which had to be put into practice in order to have a change in the administration. Any change gives rise to discussions because changes also mean resistance. But I believe that the two projects, like the Law on the pensions of magistrates, respect the constitutional provisions”, said Ilie Bolojan.

The Economic and Social Council gave an unfavorable opinion, on Tuesday, on the Government's Emergency Ordinance Project, which caused the postponement of the Government meeting by almost two hours, notes News.ro.

Several ministries sent a large number of observations to the draft GEO with administrative reform. Two such addresses, from the Ministry of Labor and the Ministry of Finance, obtained by Profit.ro, include almost 70 pages of observations and recommendations regarding the problems generated by the legislative changes. Finance recommends the reanalysis of the entire normative act, warns, among other things, that some measures may lead to the blocking of the institution's activity and draws attention to the fact that the budgetary impact on 2026 was wrongly calculated by about 100 million lei.
