They want to force the demolition of the abandoned surgery of the Zheleznogorsk hospital through the courts

In the Krasnoyarsk Territory, the administration of Zheleznogorsk is demanding through the court that the building of the surgical department of the local hospital be declared unsafe and demolished or reconstructed. The corresponding claim was submitted to the Arbitration Court of the Krasnoyarsk Territory.
The defendant in this case will be Clinical Hospital No. 51 of the FMBA of the Russian Federation. The lawsuit states that building No. 7 on Kirova Street in Zheleznogorsk, with an area of almost 3.5 thousand square meters, was transferred to the hospital under the right of operational management. However, it has not been in use for more than 20 years and is in clearly disrepair: doors and windows are missing, walls and ceilings have begun to collapse.
“The territory does not have sufficient fencing and security, which allows unauthorized persons, including minors, to easily enter. According to the administration, the facility poses a threat to the life and health of citizens,” the court’s press service says.

In 2023, the building was included in the list of abandoned or emergency facilities maintained by the Ministry of Construction and Housing and Communal Services of the Krasnoyarsk Territory. However, the hospital does not take any measures to ensure safety, despite written requirements.
Therefore, the administration decided to go to court and asked that the building be declared unsafe, and then either demolished or reconstructed within 6 months.
In this regard, the plaintiff asks to recognize the disputed non-residential building as unsafe and subject to demolition or reconstruction, and also to oblige the defendants to demolish or reconstruct the said building within 6 months after the court decision enters into legal force.
