Magistrates' pensions represent a problem that has “trailed” in Romanian society and the Constitutional Court (CCR) must take on this subject, President Nicușor Dan said on Thursday evening, during a press conference after participating in the informal European Council.
The head of state categorized the CCR's decision to postpone for the fifth time the taking of a decision on the constitutionality of the normative act that modifies magistrates' pensions as a “procrastination”.
“I don't want to comment much, because it is an authority that constitutionally has the freedom of appreciation, but it is a problem that society wants solved, which has been brewing for a long time. I want an assumption from the CCR”, declared Nicușor Dan.
Asked if it was a procrastination of the constitutional court, the president answered: “Obviously it's a procrastination, we all see it.”
CCR postponed on Wednesday, for the fifth time, a decision regarding the reform of magistrates' pensions, setting a new deadline for February 18.
Wednesday's decision was made with 8 votes in favor and one against, according to HotNews sources.
The CCR motivated the postponement decision by the request to interrupt the deliberations to study the documents submitted by the author of the referral, the High Court of Cassation and Justice (ICCJ), on February 10, 2026.
In addition, judge Gheorghe Stan also submitted a request to be referred to the CJEU, distinct from the one already submitted on Tuesday by the ICCJ.
“It is a request that came now, so it must be analyzed. We cannot vote until we are clear with all the documents,” CCR sources told HotNews, referring to the request sent by the ICCJ on Tuesday.
“On February 18, we either decide to send it to the CJEU, or we admit or reject the referral, I hope so,” said the sources.
