The Timișoara Court of Appeal rejected on Tuesday, February 10, the request of the mayor of Timișoara to annul the report of the National Integrity Agency. The decision can be appealed by Dominic Fritz to the Supreme Court.
The integrity inspectors declared Dominic Fritz in an administrative conflict of interest, because in 2020, after being elected mayor of Timișoara, he approved a report amending a PUZ, which he submitted to the City Council for approval. The technical documentation for the beneficiary of this PUZ was made by the firm of a USR local councilor, who lent the candidate Dominic Fritz an amount in lei, in the said election campaign.
Dominic Fritz challenged ANI's findings in court, and on Tuesday came the first court decision
“Rejects, as unfounded, the request for reinstatement of the case, made by the plaintiff Fritz Dominic Samuel. It rejects, in its entirety, the appeal formulated and completed, submitted by the plaintiff FRITZ DOMINIC SAMUEL, in opposition to the defendant NATIONAL INTEGRITY AGENCY, having as object – annulment of the evaluation report”, established the Timișoara Court of Appeal, according to the minutes uploaded on the justice portal.
What Dominic Fritz risks
If the decision remains final and after the appeal he will make, Fritz will be sanctioned with a 10% reduction in allowance for a maximum period of 6 months, the mayor explained in a post on Facebook.
He stated that he will appeal Tuesday's decision because his arguments at the trial were not taken into account.
“I believe ANI's interpretation is abusive and has been used as a political weapon, considering they left the report in the drawer for almost 3 years and released it a few weeks before I was elected for a second term,” said Dominic Fritz.
