“This case raises very serious questions about whether platforms are fulfilling their legal obligations to properly assess risk and prevent the spread of illegal and harmful content,” Doherty said in an official statement. The MEP emphasized that clear rules apply in the European Union and no company “is above the law.”

At the beginning of the month, the European Commission outright condemned the sharing of photos of undressed people created by AI on X, calling them unlawful and met with criticism around the world. Material depicting children was of particular concern.
xAI tried to put out the fire in mid-January by implementing fixes to prevent Grok from editing photos of real people in “skimpy clothing, such as bikinis.” However, this block is intended to be selective – it is based on the user's location and only applies to countries where such activities are illegal. However, xAI did not specify which countries it was talking about.
Brussels' investigation coincides with a tense political situation. The investigation may be perceived as hostile action towards the Donald Trump administration. The EU's crackdown on tech giants has previously sparked opposition in the US, with even threats to impose tariffs on European goods in response.
However, Musk's problems do not end with the European Union. A separate investigation is being conducted by the British authority Ofcom, which checks whether website X complies with the local Internet Security Act.
