In Friday's vote, MPs did not agree to waive the immunity of PiS MP Anna Paluch, as requested by Judge Igor Tuleya. The judge accuses the MP of slander in connection with her words about the judge's “serial fapping” of consents to operational control by the services.

The motion to waive the MP's immunity was rejected by the Sejm in Friday's vote; Previously, the parliamentary regulations committee recommended rejection of the application. 2 MPs voted for the lifting of immunity, 424 voted against and 4 abstained.

The accusation concerns “Tuleya's accusation of serially issuing decisions ordering operational control using the Pegasus system, improper performance of professional activities within the scope of his function and connections with the ruling political group – the Civic Coalition.” According to the prosecutor, Paluch could in this way humiliate him in the eyes of public opinion, damage his good name and expose him to the loss of trust necessary in the performance of his profession as a judge.

This concerns Paluch's statement from the meeting of the Rules Committee on December 3, 2024. The Committee was then dealing with a request for consent to detain and bring the former Minister of Justice, PiS MP Zbigniew Ziobro, before the investigative committee for Pegasus.

The MP then said: “The Minister of Justice, Professor Bodnar, stated that he did not know of a case of Pegasus being used outside the court's control, so what right do you have to try to use control politically, when your beloved judge Tuleya patted it serially without reading the files? You should blame him, not the services that used it.”

In the discussion on the motion in the Sejm, Paluch argued that Judge Tuleya himself, in his statements to the media, admitted that the judges of the District Court in Warsaw, who are responsible for consents to operational inspections, are overwhelmed by the number of these cases and often issue them without properly familiarizing themselves with the files. She indicated, among others: to Tulyea's statements from February 2024, quoted by the media, when the judge said that “it is very likely that he gave consent to the use of Pegasus without knowing what system would be used.” (PAP)
