Nicușor Dan states that the CCR gave him the right to refer the Court with a law, for any reason: “A return to the constitutional practice before 2018”

President Nicușor Dan stated, in a post on Facebook, that a recent decision of the Constitutional Court gives him the right to refer the CCR with a law, on grounds that may include the substance of the law, even if the project passed through the Parliament's re-examination.
“The Constitutional Court recently decided on an essential change: the President of Romania regains the right to refer the CCR regarding a law for any reason, including substantive ones, even after it has been re-examined by the Parliament”, wrote Nicușor Dan.
The head of state specifies that the change in jurisprudence took place through a recent decision of the Court.
“It is a return to the constitutional practice from before 2018, which strengthens the role of the President as the guarantor of respect for the Constitution. This clarification was made following my referral, in which the Constitutional Court admitted the objection and declared unconstitutional a law on the reorganization of some research units”, the president concluded.

Also on Saturday, Nicușor Dan announced that he had received from the magistrates “hundreds of pages of relevant materials about justice issues”.
“As promised, I am going through them this weekend, and at the end of Monday I will return with conclusions, after discussions with those who signed up for the audience,” he wrote on his Facebook account.
The president's statement comes after last week he asked the magistrates to send him materials anonymously or assumedly, with an “indefinite” discussion to be held in Cotroceni on Monday.
According to the head of state, “Monday's consultations will take place in several rounds of discussions: both with groups of magistrates who want to participate together, and individually, with those who explicitly requested this in the e-mail.”
“To ensure the confidentiality of the participants, the access of journalists will not be allowed in the discussion room. I will make the conclusions public at the end of the day in a press conference”, announced Nicușor Dan.
