Former uniformed officers are suing the state treasury. “Morawiecki's government deceived us”


At the beginning of 2023, when the Ministry of Interior and Administration (MSWiA) was headed by Mariusz Kamiński, over 8,000 policemen, 10,000 soldiers and thousands of firefighters and border guards left the service. It was the largest wave of departures in the history of the Polish uniformed services.

Traditionally, salary indexation was calculated from January, which automatically affected the amount of pensions. This time, however, the government decided to postpone it to March, which was intended to discourage officers from leaving service earlier.
The government's decision to postpone the salary indexation means that the pensions of people who finished service in January and February 2023 are PLN 300-700 lower per month than if they had left after the increase. The officers feel aggrieved and are determined to fight for their rights. “Moawiecki's government deceived us,” they complain in an interview with “Gazeta Wyborcza.”

A wave of lawsuits regarding indexation. The Commissioner for Human Rights also supported the uniformed officers
Lawsuits in this case were filed with the courts, among others: in Kraków, Katowice, Warsaw and Gdańsk. Time is running out, because the claims expire on February 28, 2026.
Retired uniformed officers are also collaborating on this matter on the Internet, hiring lawyers and suing the state treasury. They were supported by the Commissioner for Human Rights (Ombudsman). “The legislator cannot arbitrarily shape the content of the applicable standards, treating them as an instrument to achieve the goals of the current personnel policy, and this was the case of persons who were dismissed from service in the period from January 1, 2023 to February 28, 2023,” wrote the Ombudsman in an application to the Ministry of Interior and Administration.

The officers feel cheated. The ministry points to the guilt of the United Right
“I retired in February 2023 because I felt that I no longer fit into this institution,” says one of the former officers in an interview with “Gazeta Wyborcza”. The man served in prevention units for 32 years. “I gave the state three decades of my life and at the end I felt like they spat in my face,” he tells the newspaper's journalists. Now he will fight for a higher pension in court.

The Ministry of the Interior and Administration explains that its hands are tied in this matter, because the decision to postpone the wage indexation resulted from the provisions of the budget-related act for 2023. The legal act expired at the end of that year. “This results directly from the regulations adopted by the United Right government,” emphasizes the ministry in response to the request of the Ombudsman.
