Tánczos Barna, about the project regarding the prohibition of pension-salary cumulation: “If he is employed in the private sector, he can receive his full pension”

Deputy Prime Minister Tánczos Barna said on Monday (November 24th) that the draft law prohibiting the combination of pension with salary in the public sector for certain categories of employees mainly concerns special pensions and does not apply to teachers and doctors.

Tánczos Barna explained that the measure refers exclusively to the public sector and stipulates that retirees with special or military pensions who choose to remain in work after retirement age will only receive 15% of their pension in addition to their salary.
“If he re-employs in the public sector, he will benefit from 15% of his non-contributory salary. That extra pension, which is granted for certain categories of employees… judges, prosecutors, soldiers, policemen, gendarmes and those from other similar structures fall into this category.
If he is employed in the private sector, he can receive his full and contributory pension, and the special one… because he contributes to the economy. No restrictions apply there. I hope there are no exceptions, it must be the general rule”the deputy prime minister told Digi24.
According to him, “it's a rule to create a balance and fairness”
“If you have the ability to work further, after you have taken early retirement… and you want to work for the state, then you have a special pension, once again with quotation marks, lower, that is, you benefit from 15%.”, he also said.
The project also provides that state employees who reach retirement age can continue their work up to the age of 70, with the employer's consent. The changes do not apply to parliamentarians, CCR judges, those from the Court of Accounts or other institutions subordinate to the Parliament, such as ASF, ANRE, ANCOM or SRI.
“It is the proposal that was posted today on the website of the Ministry of Labor. It will enter the procedure of public debate and I hope in the shortest possible time and approval”, Tánczos Barna also said.
The Minister of Labor, Florin Manole, also stated today that “discussions continue” regarding the persons who could be exempted from the restriction of the accumulation of pension and salary.
The Bolojan government launched in public consultation the draft law that prohibits the cumulation of pension with salary for public sector employees, targeting in particular service pensions and military pensions.
The document was published on the website of the Ministry of Labor and clearly sets out the applicable conditions and exceptions.
